1. TERMS OF USE

1.1 ABOUT US
Axle Events is a platform that allows users to discover events and places.

2. INTRODUCTION
2.1 Your access to and use of the Services is subject to your acceptance and compliance with our Terms of Use. You cannot access or use the Services without accepting these Terms of Use, Privacy Policy, and Community Guidelines.
2.2 You must be over 18 to use the App and access and use the Services. If you are under 18 then you can only use the App and use the Services with permission from a parent or guardian. You must not use the Services if you are under 13 years of age.

3. OUR SERVICE
The Axle Events Service includes all of Axle Events products, features, applications, services, and software that we provide. Our mission is to create an experience of discovering your local area through local events, community and our social media. The Service is made up of the following aspects:
3.1 The Services enable you to discover places and events and acquire tickets for events, providing you with entry into venues and other establishments.
3.2 When you purchase a ticket you obtain a right to attend the event as granted by the Event organizers. The Event Organizers are responsible to you for the relevant events, and we are not liable for the event or any actions or inactions of the Event Partners – the Event Organizers.
3.3 The Services allow you to register an account that is specific to you. From this account, you are able to share and post photos and videos. To provide you with access to the Services, we must collect, process and store certain data including, at times, your personal data, which we will do in accordance with these Terms of Use and our Privacy Policy.
3.4 The Services will also provide you with recommendations regarding venues, products and events, based on your preferences, purchases and location data.
3.5 The service provides the option for registered Businesses and Event Organizers to create a “business account” to organize their own events, sell tickets and promote their events through the app.
3.6 The Services may be updated from time to time, in order to provide additional functionality or to carry out any maintenance or upgrades to existing functionality. 3.7 We may change the terms and conditions, in accordance with our new updates or any updates concerning our app at any time.

4. COMMUNITY GUIDELINES
We've established community guidelines for using Axle Events, to make sure our Services are pleasant for every user. In order to use the Axle Events Service, you must comply with the Community Guidelines, as well as all applicable laws, rules, and regulations in accordance with EU laws and regulations. These Guidelines are designed to ensure that the Services we offer foster a happy community. The guidelines apply when you are using the Axle Events website, application, or other related service. By using Axle Events you agree to these guidelines and our Terms of Use and Privacy Policy.
4.1 The following is not permitted for any reason whatsoever in relation to our Services and the material or content made available through the Services, or any part thereof:

  • Engage in any activity that disrupts or interferes with the App's operation or security and post, transmit, or share any content that is unlawful, defamatory, obscene, or otherwise objectionable.
  • You cannot do anything unlawful, misleading, or fraudulent or for an illegal or unauthorized purpose.
  • You may not post content that illicitly promotes the sale of regulated or illegal goods or content that promotes, solicits, or facilitates child sexual abuse or exploitation.
  • You may not post content that promotes graphic or gratuitous depictions of violence, gore, or other shocking imagery or content that contains sexually explicit material.
  • You cannot do anything to interfere with or impair the intended operation of the Service. This includes misusing any reporting, dispute, or appeals channel, such as by making fraudulent or groundless reports or appeals.
  • Engage in any activity that disrupts or interferes with the App's operation or security.
  • You cannot sell, license, or purchase any account or data obtained from us or our Service.
  • Infringe any third-party rights: You cannot use someone else's private or confidential information without permission or do anything that violates someone else's rights, including intellectual property rights (e.g., copyright infringement, trademark infringement, counterfeit, or pirated goods).
  • Attempt to gain unauthorized access to any user accounts or parts of the App.
  • You may not impersonate someone or something you aren't, and you can't create an account for someone else unless you have their express permission in writing.
  • You cannot use our domain name, URL, or Name in your username without our prior written consent.

5. PAYMENTS
5.1 When you provide payment information, you represent and warrant that the information is accurate, that you are authorised to use the payment method provided, and that you will notify us of changes to the payment information.
5.2 Axle Events uses the 3rd party payment platform, myPOS, and in conjunction, the myPOS API to process credit and debit card transactions for your Axle Events account. Axle Events is a “Client” as defined in the myPOS Terms of Service. The merchant for these transactions is a registered under TEB BG OOD, acting on behalf of Axle Events, to proceed payments.
5.3 By using Axle Event and agreeing to the Axle Events Terms and Conditions, You also agree to be bound by myPOS's Terms of Service.
5.4 You expressly understand and agree that Axle Events shall not be liable for any payments and monetary transactions that occur through Your use of the Service. You expressly understand and agree that all payments and monetary transactions are handled by myPOS. You agree that Axle Events shall not be liable for any issues regarding financial and monetary transactions between You and any other party, including myPOS.
5.5 You are responsible for all transactions (one-time, recurring, and refunds) processed through the Service and/or myPOS. Axle Events is not liable for loss or damage from errant or invalid transactions processed by myPOS. This includes transactions that were not processed due to a network communication error, or any other reason. If You process a transaction, it is Your responsibility to verify that the transaction was successfully processed.
5.6 You understand that Axle Events uses the myPOS API to run the Service and that the myPOS API is subject to change at any time and such changes may adversely affect the Service. You understand and agree to not hold Axle Events liable for any adverse affects that actions (whether intentional or unintentional) on the part of myPOS may cause to Your Axle Events account, or Your business.
5.7 You must not process stolen credit cards, or unauthorised credit cards through myPOS and/or Your Axle Events platform.

Termination
We reserve the right to terminate your use of our app at any time and for any reason, without notice.

Disclaimer of Warranties
Our app is provided "as is" and without warranties of any kind, whether express or implied. We do not warrant that our app will be error-free or uninterrupted, or that any content or materials on our app will be accurate or complete.

4.2 Violating our Community Guidelines may result in the removal of content or material you've contributed to the Services and/or termination or suspension of your account. We have the right to suspend your account without a reason nor do we owe the right to give an explanation.

5. PRIVACY POLICY
We may collect personal information that you provide directly to us, such as your name, email address, phone number, and billing information when you register an account, or make a purchase. The information you provide is instrumental in enhancing your experience on the Axle Events platform. Through the data you provide, we analyze trends in your behavior to identify your preferences, tastes, geographic location, favorite venues, and events. This enables us to optimize your experience on our platform. This privacy policy explains how we use your personal information and other data we collect when you use our platform.

5.1. COLLECTED INFORMATION
- Contact details – including your name, gender, email address and phone number.
- Payment card and billing details – when you buy tickets through Axle Events, we will need your payment and billing information (such as cardholder details, payment method and billing address) so we can handle your ticket orders.
- Location data - When you permit access to your device's geolocation, we collect GPS data to enhance personalized recommendations for events and venues on the Axle Events Platform. You can disable geolocation in the App's settings. Location is also required when you want to post to our social feed through photos/videos on the Axle Events platform.
- Your user preferences – we may collect information about your view history, purchase history, events you have viewed, attended, or enquired about, any communities you have joined, events you have shared, type of post or events you have reacted to or invited people to attend and any feedback you may give or reviews you may submit.
- Your interactions with us – for example, if you send us information via email, survey, social media, customer service communications or other methods, this may be stored on our system.
- Technical information –logs from your browser or mobile platform, including the location, IP address and necessary cookie information.
- Your Feedback - when conducting a survey, we may collect your views, opinions and suggestions.

5.2 HOW WE USE YOUR INFORMATION
- We may use the information we collect for various purposes, including but not limited to:
- Setting up an account for you.
- Personalizing your user experience.
- Providing you with tickets for events.
- Providing and improving our products and services.
- Sending you personalized notifications and updates.
- Understanding user preferences and trends for improving our platform.
- Analyzing and preventing potential security risks.
- Investigating, responding to and resolving complaints and Service issues (e.g., bugs).

6. COOKIE POLICY
6.1. Cookies are employed on our website and app to identify you separately from other users, ensuring a pleasant browsing and app usage experience. By storing small data files on your browser or device's hard drive (with your agreement), we can continually enhance our site's functionality.
6.1. Strictly necessary cookies: Essential for website operation. They allow secure logins, shopping cart use, and e-billing services. Internal use only, short expiry periods.
6.2. Functionality cookies: Recognize you on return, personalize content, and remember preferences.
6.3. Analytical/performance cookies: Count visitors, and track movement for website improvement.
6.4. Targeting cookies: Record your visit, pages, and links for relevant advertising. May be shared with third parties with your consent.
6.5. Marketing cookies: Target advertising based on user behavior, including data sharing with Event Partners for marketing.

7. DATA RETENTION
We keep most of your personal data for as long as your account is open.

8. Third-Party Links
Our website may contain links to third-party websites. We are not responsible for the privacy practices or content of those websites. Please review their privacy policies before sharing any personal information.

9. Changes to This Privacy Policy
Our Services are dynamic, and we often introduce new features, which may require the collection of new information. If we collect different personal data or change how we collect, use or share your data, we will notify you and may also modify this Privacy Policy.

10. CONTENT AND INTELLECTUAL PROPERTY RIGHTS
10.1 Licenses that you grant to us
Users retain ownership of the content they post on Axle Events. However, by sharing content on the platform, users grant Axle Events a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute the content. This license allows Axle Events to operate its services and promote user content within the platform.
You grant us a non-exclusive, transferable, royalty-free, worldwide license to use your name, trademarks, and logos for distribution, marketing, and promotional purposes, in connection with your use of our Services
You are solely responsible for all User Content that you post.

11. LIMITATION OF LIABILITY
We strive to maintain Axle Events as a safe and reliable platform, but please be aware that you use it at your own risk. You receive our app with no guarantees, either stated or implied. We don't promise its quality, suitability for certain purposes or non-infringement of rights.
We cannot guarantee that Axle Events will always be secure, error-free, or without disruptions or delays. Additionally, our service is not responsible for the actions, content, information, or data of third parties. By using the platform, you release us, our directors, officers, employees, and agents from any claims and damages related to third-party actions. We will not be liable for any lost profits or other consequential, special, indirect, or incidental damages arising from this statement or your use of Axle Events.

11.1. Governing law and dispute resolution
In circumstances where specific laws may prevent us from limiting or excluding liability for incidental or consequential damages our app's liability will be restricted to the extent allowed by the applicable law governed in the laws of the EU and where applicable.

12. Changes to Terms of Use
We may update these Terms, including any additional Axle Events terms and conditions, by notifying you through various means, such as posting them on the Axle Events Service. For significant changes, we will aim to inform you by email, in-service pop-up message, or other prominent notices within the Service. Your continued use of our Service after any changes will indicate your acceptance of the updated Terms.
